Terms of Service

These Terms of Service govern your use of the qüit mobile application ("App") and related services provided by Halo Sp. z o.o. By using the App, you accept these terms.

1. Parties

The service provider is:

The user ("You") is an adult or person aged 16+ who has installed the App and is using its features.

2. Nature of Service and Medical Disclaimer

The qüit app is a tool to support quitting smoking: progress tracking, motivation, education. The App does not provide medical services, does not replace advice from a doctor, therapist, or addiction specialist. In case of severe withdrawal symptoms, depression, or suicidal thoughts - contact a doctor immediately or call emergency number 112 (EU) / 911 (US) / your local crisis line.

3. Subscription and Payments

The qüit app offers an auto-renewable Premium subscription:

qüit Premium is a monthly or annual auto-renewing subscription.

Payment will be charged to your Apple Account or Google Play account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price. You can manage and cancel your subscription by going to your App Store account settings (iOS) or Google Play (Android) after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

The current subscription price is shown in the App before purchase. The price includes VAT at the applicable local rate.

4. Cancelling Subscription

You can cancel your subscription at any time. Cancellation does not refund the current period - Premium will remain active until the end of the paid period and then expire.

How to cancel:

  • iOS: Settings → Your Name → Subscriptions → qüit → Cancel Subscription.
  • Android: Google Play app → Menu → Subscriptions → qüit → Cancel Subscription.

5. Refunds

Refunds are handled by Apple or Google in accordance with their store policies - Halo Sp. z o.o. does not have technical means to issue refunds directly.

6. Right of Withdrawal

Pursuant to Art. 38 point 13 of the Polish Consumer Rights Act of 30 May 2014, by consenting to the immediate provision of digital service (subscription) upon purchase, you waive the right to withdraw from the contract within 14 days. Premium delivers access to digital content immediately upon payment, so this exception applies.

7. User Account

You can create an account using:

  • e-mail and password,
  • Sign in with Apple,
  • Sign in with Google.

You are responsible for keeping your login credentials confidential. You can delete your account at any time from within the App: Settings → Delete account. The operation is immediate and irreversible; all your data (except where required by tax law) will be permanently erased.

8. Application License

Use of the App on Apple devices is governed by Apple's standard "Licensed Application End User License Agreement":

Pursuant to that license, Apple is not responsible for the App - all claims are directed to Halo Sp. z o.o. Apple is a third-party beneficiary entitled to enforce the agreement.

9. Disclaimer of Warranties and Limitation of Liability

The App is provided "as is", without warranty of uninterrupted operation, freedom from errors, or achievement of specific outcomes (e.g., permanent smoking cessation). Effectiveness of quitting depends on many individual factors beyond the App's control.

To the extent permitted by law, Halo Sp. z o.o.'s liability is limited to the subscription amount paid in the 12 months preceding the claim. This limitation does not exclude liability for damage caused intentionally, nor for personal injury caused by intent or gross negligence.

11. Changes to These Terms

We may update these Terms. We will notify you of material changes 30 days in advance via the App or e-mail. Continued use of the App after changes take effect constitutes acceptance of the new version.

12. Complaints and Dispute Resolution

Please direct complaints about the App to kontakt@halo.com.pl. We will respond within 14 days. If you are not satisfied with the response, you may use the European Commission's ODR platform: ec.europa.eu/consumers/odr.

13. Governing Law and Jurisdiction

These Terms are governed by the law of Poland. Disputes are settled by the court competent for the registered office of Halo Sp. z o.o. (Katowice), subject to mandatory consumer-jurisdiction provisions.
